Terms of Service

These Terms of Service ("Terms") govern your access to and use of Goloby's website, admin application, guest guide platform, and related services (collectively, the "Service"). By creating an account, subscribing, or using the Service, you agree to these Terms.

If you are using the Service on behalf of a hotel, property, or organization, you represent that you have authority to bind that entity to these Terms.

Goloby enables hospitality businesses to create, publish, and manage digital guest guides that guests can access in their mobile browser, typically via QR code. Features may include property information, WiFi details, local recommendations, print-ready QR codes, analytics, multi-language support, and AI-assisted content suggestions.

We may update, modify, or discontinue features from time to time. We will use reasonable efforts to avoid materially reducing core functionality during an active paid subscription period, except where required for security, legal compliance, or operational reasons.

You must provide accurate account information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must notify us promptly at the contact address below if you suspect unauthorized access to your account.

Goloby is offered as a subscription service. Current pricing is published on our website and may include a monthly plan at $29/month or an annual plan billed at $288/year (equivalent to $24/month). Prices, features, and billing intervals may change, but we will provide notice before changes apply to your subscription.

If a free trial is offered, it will be described at signup. Unless you cancel before the trial ends, your subscription may convert automatically to a paid plan and your payment method may be charged.

Subscriptions renew automatically until canceled. You may cancel at any time through your account settings or by contacting us. Cancellation stops future billing, but fees already paid are non-refundable except where required by law.

After cancellation, your guide may remain live until the end of the current billing period. After that, your guide may go offline and printed QR codes may stop working.

You retain ownership of the content you upload or create in Goloby, including property details, recommendations, images, and translations ("Customer Content"). You grant Goloby a worldwide, non-exclusive license to host, store, reproduce, display, and distribute Customer Content solely to provide and improve the Service.

You are solely responsible for Customer Content and for ensuring that it is accurate, lawful, and appropriate for guests. You must not publish content that is false, misleading, infringing, defamatory, obscene, discriminatory, or otherwise unlawful.

You are responsible for obtaining any rights, permissions, or consents needed for content you publish, including photographs, third-party business listings, and translated materials.

You agree not to:

• Use the Service for unlawful, fraudulent, or harmful purposes.
• Attempt to gain unauthorized access to the Service, other accounts, or related systems.
• Reverse engineer, scrape, or interfere with the normal operation or security of the Service.
• Upload malware, spam, or content that violates the rights of others.
• Misrepresent your identity, property, or affiliation.
• Use the Service in a manner that could damage Goloby's reputation or impose unreasonable load on our infrastructure.

Goloby may offer AI-assisted suggestions for guide content, translations, or recommendations. These outputs are provided for convenience only and may be incomplete or inaccurate. You are responsible for reviewing, editing, and approving all content before publishing it to guests.

Guest guides are accessed through public URLs and QR codes. You understand that anyone with access to a guide URL or QR code may view published content.

We strive to keep the Service available, but we do not guarantee uninterrupted or error-free operation. Maintenance, outages, network issues, or third-party failures may temporarily affect access to guest guides.

Goloby and its licensors own the Service, software, branding, documentation, and all related intellectual property, excluding Customer Content. You may not copy, modify, distribute, sell, or lease any part of the Service except as expressly permitted in these Terms.

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Goloby disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will meet your requirements, that guest guides will generate any particular business outcome, or that all content suggestions will be accurate or complete.

To the fullest extent permitted by law, Goloby will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from or related to the Service.

To the fullest extent permitted by law, Goloby's total liability for any claim arising out of or relating to the Service or these Terms will not exceed the amount you paid to Goloby for the Service in the twelve (12) months before the event giving rise to the claim.

You agree to indemnify and hold harmless Goloby and its affiliates, officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from your Customer Content, your use of the Service, or your violation of these Terms or applicable law.

We may suspend or terminate your access to the Service if you violate these Terms, fail to pay applicable fees, create security or legal risk, or if we are required to do so by law.

Upon termination, your right to use the Service ends. Sections that by their nature should survive termination will continue to apply, including provisions relating to content ownership, disclaimers, limitations of liability, and indemnification.

We may update these Terms from time to time. If changes are material, we will provide reasonable notice, such as by email or through the admin application. Continued use of the Service after the effective date of updated Terms constitutes acceptance.

These Terms constitute the entire agreement between you and Goloby regarding the Service and supersede prior agreements on the same subject.

If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later.

You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
